I would like to get your valuable suggestions regarding my inter railway request transfer to BZA division of S.C.Rly.
HISTORY OF CASE : I am a physically handicapped person working as Sr.Clerk in UBL division of S.W.Railway. During 2009 I have applied for IRRT to BZA division of S.C.railway through S.W.Railway and the same has been forwarded to S.C.railway. CPO/SC has asked to Sr.DPO/BZA during 2009 to put up vacancy position in Sr.Clerk's grade in all Departments of BZA division vide my IRRT application. But after wards there was no file moment.
Then I have asked about my IRRT application position under RTI Act, and they replies as follows.
1) The IRRT application of Sri.A.Aswani pothuraju has been kept in Ist priority in the priority register on 28.10.2009 in CPO/O/SC.
2) The request transfer will be considered based on vacancy position.
3) Sri.DPO/BZA has been advised by CPO/SC that the said employee can be accommodate in BZA division against 20% DR Quota.
MATTER BROUGHT LIGHT
As per PCDO vacancy position of August, 2011 of operating Dept. of BZA Divn. shown in the Official web site of S.C.railway, that 03 Nos. of Sr. clerks vacancies available in DR quota. Out of 03 vacancies for 02 vacancies indent placed in PH Quota by BZA division and sent to CPO/SC vide Lr.No.B/P.563/III/5/Clerks/Vol.III of 28.4.2010. Still one more vacancy is available in Operating Dept. of BZA division under D.R.Quota.
My self is also P.H. employee, B.Com., Graduate and working as Sr.Clerk and my IRRT application has been received during 05/2009 and Sr.DPO/BZA has been asked by CPO/SC about the vacancy position in Sr.Cleerk's grade in all depts. of BZA division on 04.11.2009 i.e. before placing indent to till up Sr.Clerks vacancy against P.H.Quota.
But, Sr.DPO/BZA did not respond to CPO/SC Lr.No.P/E/676/Clerks/IRRT of 04.11.2009 and failled to inform the above said vacancies to CPO/SC against my IRRT application.
In this regard I would like to provide the Railway Board guide lines for Your ready reference please.
As per Rly.Bd.Lr.No.E(NG)I-82/TR/26 dt. 06.6.1983 If a vacancy exists in the cadre at the place where the employee seeks transfer, there should be no difficulty in immediate accepting the request and informing the cadre authorities from where the transfer to be effeted.
As per Rly.Bd's DOP & T.S. O.M.No.AB-14017/41/90-Estt (RR) dt. 10.5.1990 circulated in Bd's Lr.No.E(NG)1-91/TR/13 of 11.02.92 (RBE 23/1992) Request from Physically handicapped employee for transfer to or their native place may be given preference.
After wards I have appeal to SDGM/SC regarding non consideration of Request transfer then CPO/SC railway has asked me to submit Fresh IRRT application and I have submitted Fresh IRRT application during Feb., 2013.
Hence please advise
1) Can I approach to CAT as SC railway neglected my IRRT application even though I was kept in Ist priority from 2009 and they have recruited through DR Quota (PH) by placing indents even though I am physically handicapped person working as Sr.Clerk and my application is exists in S.C.railway before placing indent to SC railway HQ's.
2) As asked by CPO/SC I have submit fresh IRRT application during Feb., 2013. But, my previous IRRT application has been kept in Ist priority on 28.10.2009. Will I get my privious priority?
3) Please inform me If I have to go to CAT, where I have to file case against S.C.railway authority, whether CAT/Bangalore as I am working is S.W.Railway (or) in CAT/Hyderabad as my grievence with S.C.Railway authorities.
