Y was promoted to the grade pay of 4200 w.e.f. 14/11/2005, who has opted to fix his pay from the date of next increment 1/4/2006. After implementation of 6th CPC, he has revised his option for the promotion by fixing his pay from the date of promotion itself with dni on 1/11/06. His pay was brought to 6th CPC from 1/1/06 onwards. Now as per GoI orders dated 19/3/12, Y is claiming to reopen his promotion case and he be granted the additional increment as on 1/1/06 as his increment in the pre-revised 5th CPC fell on 1/4/06. Can the individual give another option for the above said promotion and revise his pay fixation from the date of increment? If yes how to fix his pay in 6th CPC?
