I was TC on Bikaner station of NW Railway, On 12.sep.2010 i was removed from railway service because of conviction on a criminal charge. In my case the Disciplinary authority was group B officer of commercial department. He imposed major penalty removal from service under rule 14(i) of railway servants D&A rules 1968 on me. After this i represent the appeal to Sr.DCM for quash the order of DCM, but he rejected my appeal, At last i submit the revision to ADRM Bikaner but he also rejected my revision....................
All these officers given me only one reason that my conviction of criminal case is not suspend, and the high court dose not pass any kind of orders which is show that my criminal conviction is suspend so they can't pass the orders to taken back to me on duty....All proceedings in my case NW railway officers spend time from 12/08/2010....Now i describe about the fact of my criminal case which are these...
(1)...When in the additional session judge (fast track) no.2 of Bikaner was convicted me in criminal case on 06/feb./2010,the court sentence me three year simple RI and fine 5000 rupees, and if i can't pay fine then six month extra RI face by me. But after my advocate hearing the court suspend the sentence on very same day that's why i was not send to jail. After the jodhpur high court suspend my sentence till final decision of my criminal appeal, but not pass any order about on my conviction.
(2)..Meantime i file a criminal miscellaneous application no.1916/2010 for suspend the conviction in jodhpur high court.this application heard by court from 2010 to april 2012.
(3)...On 27.april 2012 the jodhpur high court pass the order in criminal misc. application No.1916/2010 in my favour, the court suspend the conviction till my apple pending.
Then i file my representation to Sr.DCM bikaner for taken back me on my duty on the base of suspended conviction, But they not pass the order in my favour. So please told me that what can i do for back duty. Please give me some suggestions about that problems.
