Railway Services(Conduct) Rules 1966

Conduct Rule

  • Revised as per the recommendations of Santhanam Committee.
  • Prescribe standards of conduct expected of a Railway employee and members of his family.

Guiding Rules

  • Every Railway employee shall at all times-

(i) maintain absolute integrity;
(ii) maintain devotion to duty; and
(iii) do nothing which is unbecoming of a Railway employee.

  • Every Railway employee holding a supervisory post shall take all possible steps to ensure the integrity and devotion to duty of all Railway employees for the time being under his control and authority,
  • No Railway employee shall, in the performance of his official duties, or in the exercise of powers conferred on him, act otherwise than in his best judgment except when he is acting under the direction of his official superior.
  • The direction of the official superior shall ordinarily be in writing, and where the issue of oral direction becomes unavoidable, the official superior shall confirm it in writing immediately thereafter.
  • A Railway employee who has received oral direction from his official superior, shall seek confirmation of the same in writing as early as possible, whereupon it shall be the duty of the official superior to confirm the direction in writing.

Promptness and Courtesy 

  • No Railway employee shall -
    (a) in the performance of his official duties, act in a discourteous manner;
    (b) in his official dealings with the public or otherwise adopt dilatory tactics or willfully cause delays in disposal of the work assigned to him.

Observance of Government's policies

  • Every Railway employee shall, at all times
    (i) act in accordance with the Government's policies re¬garding age of marriage, preservation of environment, protec¬tion of wildlife and cultural heritage;
    (ii) observe the Government's policies regarding prevention of crime against women.

Gifts

  • Include free transport , boarding/lodging, Dowry etc.
  • They may be accepted fromnear relatives or personnel friends having no official dealings subject to the following limits.

 

On occassions such as wedding anniversaries, funerals, religious functions

Trade and Business

  • Not to raise subscription.
  • Not to secure job for relations,
  • Group A employees should not permit their sons to work in firms having official relations with them.
  • Not to enagage in any trade etc.
  • Not to engage in social/charitable work.
  • Not to borrow/lend where official dealings are there.

Demonstrations/Associaltions

  • No Railway employee shall join an association or Union or participate in any demonstration the objects or activities of which are prejudicial to the interest of the sovereignty and integ¬rity of India or public order or morality.
  • Not to allow in their family members to participate in any movement/activity subversive of Governement, established by law.
  • Railway employee should not accept complimentary/valedictory address except on transfer etc.
  • Officers are not permitted to join trade unions.

Indebtedness

  • Avoid habitual indebtedness.
  • Report insolvency proceedings to Government.

Ensure impartiality

  • Do not take part in in politics/elections.
  • Voting in an election is not prohibited.
  • Not to criticise Government.

Drinking

  • Prohibited in Dry areas, public places, on duty or in excess.
  • Marriage when a spouse is living. Permitted if permitted by personal law, Government approval is needed.
  • Politics or other influence should not be used .
  • Should not neglect wife or family in an unbecoming manner.
  • Railway employee responsible for delay in disposal of matter deliberately will be liable to Diciplinary action.
  • No Railway employee shall employ child below 14 years old.

Filing Returns

  • Initial All except Group D employees.
  • Annual Group A , B & Group C employees with GP 4600 or above.
  • Special returns – may be asked anytime.
  • No transaction with foreigners without prior permission.

Immovable property

  • Previous sanction is necessary if not purchased through a reputed dealer. Otherwise previous knowledge of Government is enough.

Movable Property

  • Must be reported if the value exceeds Rs.20000 for Group A & B and Rs. 15000 for others.
  • Previous sanction is necessary if official dealings are involved. 

RTI ACT

  • Communicate information to a person under RTI Act and rules made under it.. He will not communicate documents/calssified information which he is not entitled to communicate.

Indulging in cruelty to animals is liable for acton under prevention of Cruelty to Animals Act as well as Conduct Rules.

Can a Railway servant act in a movie without any remuneration?. permission required or only intimation? what is the procedure

Yes. But " No Railway employee shall join an association or Union or participate in any demonstration the objects or activities of which are prejudicial to the interest of the sovereignty and integ¬rity of India or public order or morality."

And he cant receive salary from the NGO.

i want to know that -

1, can an employee be served SF 5 for any penalty in cash imposed on him by court of law?

2,What amount of penalty in cash ,sufficient to serve the major charge sheet ,is this has any rationale with monthly basic pay/

Proceedings in court of law and departmental proceedings will go parallel. Penalty by court of law will not hinder departmental proceedings and dept action/penalty.
Issuing SF5 has no connection with basic pay.

I would like to know whether any railway doctor can appear for (i) interview to other Govt. organisation and worked as (ii) enquiry officer to any Central Govt. Organisation without intimation/permission from Railway authority. If not then wha action can be taken for violation of Railway Service rules.

One employee was issued major penalty of Removal From Service for unauthorized abscence.
and the person died before acknowledging the punishment order, but the administration said they have sent two copies to permanent and temporary address (railway quarters) in which the employee is residing for 20 years but they sent the railway quartets address wrong as well as the removal from service is effective from 31/07/2009 and they sent the order to the employee through post only on 03/08/2009 before the employee sign the punishment order the removal from service is effective. and after that they put the punishment order in notice board and closed the case, but the employee died before acknowledging the punishment order or seeing it in the notice board.
The employee is my father and i would like to know if the punishment order did not serve on the employee and he did not acknowledge it,  
is there any rule like the punishment will be set aside.  Please give details clearly sir.

Ahuja sir what do u mean by valid reasons.  He has been ill for many years and was taking medicine in railway hospital and also in his enquiry he has given explanation for his absence is his ill health and finally proving that he died just only 10 days after the order is affective.

Please let me know if this is a valid reason.

It is surprising that a Railway employee(an SSE for that matter don't know who is DPO. DPO(Divisional Personnel Officer) is the officer in charge of Personnel Department in a Division. If you are a headquarter staff Dy CPO (Deputy Chief Personnel Officer) or SPO (Senior Personnel Officer ) in Workshops. 

There is no procedures involved. You just write to him/with the details of the book to be published and the fact that it is no no way related to Railways and does not criticise Government or its institutions in any way. May be it can help that you put subject matter of the book in annexe.

Ahuja Sir,
My father was un authorizedly absent and removed from service and died before receiving his punishment order and i went to CAT, CAT given judgment to settle my matter in two months, i applied to DRM for CG appointment and settlement dues through register post.  but almost 3 months is over.  No reply from Railway,
I do not know whether they are going to high court or accepting the CAT.
Please tell me what should be my next step,
What is time available for Railway to reply to CAT or me.  How long they can keep the silence without telling anything.
If my advocate put contempt of court will the railway get angry on me, even though if i put contempt of court what is the time given for railway to reply.
 
Please give reply to all my quires sir. Sometimes i am not getting reply for all my quires.  
 

In how much time court should be implemented is a juridic question which you should ask to your lawyer. On Railways part there is no timeframe for answering any questions as you can deduce by reading comments on this site.

As for Railway getting angry, first of all Railway is not a person and the delay is the problem of the system. Hence discuss with your lawyer and decide accordingly.

if any employee has a got jail of 2 years in the case of sc st act and that time he is suspended then what is the rules and laws for his remaining service and pf allowence.

Sir, A  Assistant loco pilot with GP 1900/- was imposed a penalty of 9 months (NR) and was completed by March 2013, during the period of penalty, promotion order(Dated 06-08-12) issued for the post of Sr.ALP (GP 2400)as per restructuring of cadre with inclusion of his name but, duly issuing a letter(dated 03-09-13) stating"the promotion order of sri XXXXXX/ALP is here by treated as canceled, since he is undergoing punishment of with holding of annual increment due on 01.07.2012 in pay Band Rs 5200-20200+GP 1900 for a period of 09 months(NR)".

After completion of penalty period he was not given his promotion to Sr. ALP (GP 2400).  in this regard i required clarification whether he is eligible for promotion or not, if "yes" , promotion is eligible from the date of completion of penalty date or not. 

I(SSE) AM NOMINATED AS AN INQUIRY OFFICER TOCONDUCT D&A INQUIRY FOR LONG UNAUTORISED ABSENCE AGAINST A PARTY(TECH 3).SO PLS SUGGEST ME WHAT QUESTIONS SHOULD I ASK TO CONDUCT INQUIRY IF PARTY ATTENDS IN BOTH CASES i.e ALONE OR WITH DEFENCE COUNSEL..

You have to decide it depending on the history of the case.

3. Have you received Charge Memorandum No…. dated……. ………issued by the …………….

4. Have you been issued with order No…… dated …… appointing Shri… . as Inquiry Officer?

5. Have you taken inspection / extract of the documents listed at Annexure III? 

6. Have you replied to the charge memorandum?

7. Have you understood the charges framed against you and if so, do you plead guilty to the same or not?

8. Have you asked for any additional documents?

9 Do you wish to call any defence witness in your case? If so show their relevance.

10. Do you wish to say anything more in this case?

Sir,Iam working as sr.alp in tpj div.I got an sf11 imposing 18 months(NC) incr held up upto 31/12/2013.During my punishment period 20 Alps were promoted to sr.alp.I was promoted to sr.alp on 01/01/14 W.E.F 01/11/2013 below the above said 20 employees.
I want to know whether my seniority is fixed correctly.

I am working in P.O.H Bhusawal Division as M.C.M  since 1979 .

I want to ask you that date of birth which is written on my school cerificate is 1956, and date of birth which is in service record is 1955 .so at the i time of my retirement which date of birth railway law is going to  considerd.

and for bringing stay order for my service  shall i go for High Court .if CAT court is closed
