HOER Rules (Hours of Employment and Period of Rest Rules 2005)

 Definitions

  • Full night : period between 10 pm and 6 am
  • Long-on : a period of duty over 8/10/12 hours in case of Intensive/Continous/Essentially Intermittent workers respectively.
  • Roster : Document which shows the hours a Railway employee is expected to be on duty every day, the daily as well as weekly rest and break between spells of duty in a day.
  • Short-off : A period of rest which is

 - In case of Intensive workers less than 12 hours in a roster of six hours duty and less than 14 hours in a mixed roster of 6 and 8 hours duty.

 - In case of Continuous workers less than 10 hours.

 - In case of Essentially Intermittent workers less than 8 hours.

Authority to Classify

  • Power to declare the employment of a Railway employee Intensive or Essentially Intermittent vests with Head of the Railway Administration which can be delegated to Chief Personnel Officer.
  • During emergency situations it can be exercised by an Officer not below the rank of Senior Scale.
  • A copy of every declaration of classification shall be sent to Regional Labour Commissioner and if it is made by an Officer (Sr Scale) a copy to be sent to Head of the Railway Administration and Chief Personnel Officer.

Appeals against Classification

  • Any Railway employee aggrieved by a declaration of classification may prefer an appeal to Regional Labour Commissioner within 90 days of the date of declaration. RLC may after srutiny of documents or fresh job analysis may order for a change in classification.
  • Any Railway employee of Railway Administration aggrieved by a decision of Regional Labour Commissioner may prefer an appeal to the Secretary to the Government of India, Ministry of Labour before the expiry of 90 days from the date on which the decision of Regional Labour Commissioner is communicated.

Classification

  1. Continuous : The employment of a Railway employee is said to be continuous except when it is excluded or has been declared to be Essentially Intermittent or Intensive.
  2. Essentially Intermittent : The employment of a Railway employee is said to be Essentially Intermittent when it has been declared to be so by the prescribed authority on the grounds that daily hours of duty of the Railway employee normally include periods of inaction aggregating to 50% or more (including at least 1 such period of not less than 1 hour or 2 such periods of not less than half an hour each) in a tour of 12 hour duty (on the average over 72 consecutive hours) during which the Railway employee may be on duty, but is not called upon to display either physical activity or sustained attention.
  3. Excluded : The employment of a Railway employee is said to be Excluded if he belongs to any one of the following categories,
  • Railway employee employed in managerial or confidential capacity.
  • Armed guards or other personnel subject to discipline similar to that of any armed police forces.
  • Staff of the railway schools imparting technical training or academic education.
  • Such staff as may be specified as supervisory.
  • Matrons
  • Sisters-in-charge
  • Matrons not on regualar shift duty in Railway Hospitals
  • Health Educators and District Extension Educators
  • Family Planning Field workers
  • Lady Health Visitors
  • Auxiliary nurses-cum-midwives
  • Projectionists.
  • Other categories prescribed.
  • 4 . Intensive : The employment of a Railway employee is said to be Intensive when it has been declared to be so by the prescibed authority on the ground that it is of a strenous nature involving continued concentration or hard manual labour with little or no period of relaxation. 

Supervisory Staff

  • Ministry of Labour by written order specify Railway employees or classes of Railway employees as supervisory on the ground of holding a position of responsibility employed on duties mainly of supervisory character and because of his nature of work comparitively free to adjust his hours of duty or work.
  • Copy of every such order shall be send to Chief Labour Commissioner, New Delhi.

Criteria for Classification

  1. Continuous : All Railway employees except those excluded from Hours of Employment Regulations are assumed to be 'Continuous'. Thereafter on the basis of factual job analysis, it may be classified as Essentially Intermittent or Intensive.
  2. Intensive : Two important factors in declaring and employment as Intensive are : (i) strenuous nature of the work tending to cause mental or physical strain (ii) continuous application to such work with little or no period of relaxation. Thisis considered to have been satisfied where period of inaction or relaxation do not aggregate 6 hours or more in a cycle of 24 hours or one hour or more in a shift of 8 hours.
  3. Essentially Intermittent : If daily duty hours which should be assumed to be 12 hour/day include 
  • one period of inaction of not less than one hour or two such periods of not less than half an hour each AND
  • various periods of inaction (including that above) aggregating 50% or more during which he is not called upon to show either physical activities or sustained attention.
  • NOTE : In calculating above, periods of inaction of less than 5" shall be ignored.
  Standard Hours Statutory Limit(Sec 132 of Railways Act 1989) Preparatory & Complementary work
Intensive 42 h /week 45 h /week 3 h /week
Continuous 48 h /week 54 h /week 6 h /week
Essentially Intermittent 48 h /week + 12/24 h additional hours* 75 h /week 3 or 4 1/2 h /week *

* (i) Gateman 'C' , Caretakers, Chowkidars & Saloon Attendant and Railway employees in roadside stations provided with quarterswithin 0.5 km of place of duty - 24 h additional duty and 3h/week Preparatory & Complementary work

  (ii) Other Railway employees in EI roster -  - 12 h additional duty and 4 1/2 h/week Preparatory & Complementary work

  • Preparatory & Complementary work is treated as:
  1. When it is less than 15 min - not treated as duty, not exhibited in roster
  2. 15 min to less than 45 min (Continuous ) - half an hour
  3. 45 min to 1 hour (Continuous ) - one hour
  4. For Intensive & EI 15 min to 30 min is treated as half an hour
  • Total hours for Preparatory & Complementary work shall be fixed so as not to exceed maximum hours.

Running Staff

  • Running staff will have a link roster with standard hours 104 hours and statutory limit of 108 hours.
  • Link should be such that it wont exceed 10 hours from "signing on" to "Signing off".
  • They are given 4 periods of rest 30 consecutive hours or 5 periods of 22 consecutive hours each including a full night.

Split duty

  • Spells of duty shall not exceed 3 and no of breaks not to exceed two.
  • In case of employment of Continuous nature Railway employee whose place of residence is beyond 1.6 km from the place of duty seven hours of split duty shall be treated as equivalent to 8 hours of normal duty.
  • While preparing rosters long on and short off shall be avoided.

Sir, I am working as MCF(Sig) in RRI in "C" roaster.The duty roaster is 23 - 7, 7 - 15 and 15 - 23. We are getting accident T.A. for a Level Crossing Gate being damaged by a vehicle.
A gate was damaged on 15/02/2012 at 22 Hrs. I came to duty at 23 Hrs in the night shift. The LC gate was restored for the normal working at 03:25 Hrs on 16/02/2012. But I am denied the TA for 16/02/2012. I have been told that accident TA is admissible for only one day only, although the work has spread on two working days as per the timings. what is the rule for the same. Am I eligible for only One accident TA. Previously we used to claim accident full TA for both days.

I presume that you got TA because you went for duty at accident spot. If the time spent there spreads on two days you are eligible for both days.

I agree with u Sir, but now my supervisor has refused that in case of accident only one TA is admissible, though the work has been spread for two days then also. I comented that if a train accident takes place then although the movement has been restored then also till the crane working is going on accident TA is admissible. (Accident  TA is given 100% or full one TA no matter of the time for the day) Sir if you have some document proof for the same can u please be kind in passing the same to me so that I along with other sufferers can be benefited.        I am a Dy CTI.

      After working for 5 days in two different trains for about 27 Hrs and 30 Hrs stay at out station (ie; MAS - HX - MAS  13 Hrs, and 17 Hrs stay at HX, and  MAS - SBC - MAS  14 Hrs and 16 Hrs stay at SBC). On the sixth day I work in a train from 06:00 Hrs to 21:45 Hrs up an down (MAS - MYS - MAS). 

                    ​​On the seventh day I am booked for another train from 23:30 Hrs to 06:00 Hrs and return to Headquarters by 15:00 Hrs on the eighth day (Supposed to be rest). Is it correct as per the HOER.

I'm working as an ECRC

I'm working as an ECRC (Reservation clerk) in a single counter station with two shifts, where the salary bill is dealt by the SM there. I'm been insisted to write my duty timing in the muster on daily basis when I sign, rather than writing morning or general shift. Is there a rule so and if so, is it applicable to the ECRC's who don't have night shift.

Next  is for the morning shift a 15 minutes break is allowed for the B'fast between 9 to 10 am and is displayed in the counter from 9:30 to 9:45 hrs and the so called SM is arguing on that there is no rule for such a break for any categories of Rly employee and it is a local adjustment. Iwould like to get the correct information on this regards.

There is only one HOER rule for all Indian Railways, whether you are ECRC or SM. The roster is decided by DPO after taking into view of your commercial manager(DCM) duly obeying provisions of HOER. Hence it depends on your approved roster. If 15 minute brake is shown in the roster it is allowed and you can publish on the counter, otherwise not.

We are having a peculier

We are having a peculier problem. The commercial clerks working in the Railway booking counter are given split roster as follows.

04.00 to 08.00 and 16.00 to 20.00

The off duty hours will be a maximum of 8.00 hours only in between any two spells. We feel it falls under the definition of Short Off and violative of HOER provisions. 

Kindly clarify.

Short off depends on your

Short off depends on your roster. It is less than 10 hours in case of C roster and less than 8 hours in case of EI roster. Short off should be avoided while preparing roster.

No. i didn't get any such letters. Only the verification of certificates has been completed in december and got short listed.

    I am TTE and we have a train which starts at 17:25 and reach the destination at 00:15 hrs ( the running time is 6 Hrs and 50 mins) i ncluding preparatory hours it becomes 7 hrs and 50 mins, i suppose. The same train starts back at 03:20hrs and reach back at 10:05 ( running hours of 6hrs 45 mins).

    Here the rest at outstation is only 3 hrs 5 mins ( deducting preparatory hours, REST will become 2 hrs 5 mins). My doubt is this not a violation of HOER. Please clarify. Thank you

For duty of 8 hours or more , normally they should give you 16 hours rest. But  emegrent situations you can be called before this period;

whether should he come to the headquarter station by the first available train

can he proceed to the headquarter station by the first available train after taking minimum rest of 8 hours at the other station????????????

 

When a Railway employee

When a Railway employee proceeds on duty, he has to come back to his headquarters as soon as the his duty is over. You are supposed to come back by the next available train. RG SM rosters are normally prepared in such a way as not to exceed Standard hours of 48 (inRoster C) including travelling time. You can claim Overtime beyond that

Dear Sir, I'm working as a loco pilot in Mumbai Div. I'm working in roster detail (i.e. 8 hrs shift, 8/16, 16/24 and 00/08). Last month I was on sick leave for a period of 10 days. Prior to my sick leave I had worked for 3 days and after my sick leave was over, I worked for a day. i.e. I worked on 1st, 2nd and 3rd of the month. from 4th to 13th I was on sick leave. Again I attended duty on 14th. Can I avail my weekly rest on the 15th??? My supervisor has denied me the rest asked me to take C.L. instead. Please guide. Thank you.

Even though we hear generally

Even though we hear generally that you cant avail rest after sick I dont see a rule for that. I have marked rest many times for myself and employees working under me , but nobody objected it so far.
